Just before Easter 2024, Alpha were successful in winning another third adjudication for a small dry lining sub contractor against a midlands based main contractor where the Adjudicator found in favour of our sub contractor using the limited form of Adjudication for small value disputes. Payment was made within 7 days and full liability of adjudicator costs was also awarded against the main contractor.
Alpha were appointed to assist a Partner in a carpentry sub contract business run as a Partnership to help resolve a dispute with his former business partner and allow for his retirement from the business. Ultimately this dispute was successfully concluded through a formal Mediation process led by a KC that enabled our Client to get a successful outcome both financially and for his peace of mind.
Alpha have also recently been appointed to advise a former Director and Shareholder of an IT and Telecoms business that has been unfairly dismissed from the Company to receive fair recompense for his employment and fair value for his shares. Employment lawyers have been engaged and this matter will go to Mediation in May 2024 to hopefully conclude. Failing that then the matter will proceed to litigation where we will support our Client through our access to litigation funding.
Alpha have also successfully arranged for litigation funding circa £270,000 made available to a Client to pursue 2 matters of adjudication , with Alpha taking the lead role in preparation and prosecution that has resulted in a successful award of £970,000 for the Contractor and a successful Enforcement award of that Decision in the High Court.
Alpha has in recent months prepared, served and been successful in running adjudications for a sub contractor against Equans Regeneration Ltd. In the first adjudication , the adjudicator had been appointed when Equans elected to settle in full including costs. In the second adjudication the Adjudicator found in our favour on every point bar one and a significant award plus full adjudicators costs went against Equans. Alpha are now instructed to pursue the Final Account including loss and expense on behalf of our Client.
